Terms of Service

These Terms of Service (“Terms”) govern your use of the Crucible Care website at crucible.fit and any associated applications and services (collectively, the “Services”). The Services are operated by Crucible Care (“Crucible Care,” “we,” “us”). By using the Services, you agree to these Terms.

1. Nature of Services

Crucible Care is a fitness and wellness provider offering a coach-led strength and balance program for adults aged 60 and older in partner senior living facilities.

Crucible Care is not a medical provider. Content on the Services is for general informational purposes only and is not medical advice, diagnosis, or treatment. Consult a qualified physician before beginning any exercise program.

2. Program Delivery Through Facilities

Program participation by residents is governed by a separate agreement between Crucible Care and the partner facility, together with a participant waiver and informed consent signed by the resident (or their authorized representative). Nothing on the public Services creates a program agreement between Crucible Care and any individual resident or family member.

3. Accounts

Facility staff, coaches, and administrators may be issued accounts on the platform. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at care@crucible.fit of any unauthorized access.

4. Acceptable Use

You will not:

  • Use the Services to violate any law or third-party right
  • Attempt to reverse engineer, decompile, or extract source code from the Services
  • Access data you are not authorized to access, including data belonging to other facilities or residents
  • Introduce malware, scrape at scale, or overload the Services with automated traffic
  • Use the Services to send unsolicited communications or for any purpose other than its intended use

5. Intellectual Property

All content on the Services, including program methodology, session templates, assessment protocols, exercise library, text, graphics, logos, and software, is owned by Crucible Care or its licensors and protected by U.S. and international intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You may not copy, adapt, redistribute, or create derivative works without our prior written permission.

6. Outcome Claims

Outcome statistics, percentages, and case studies appearing on the Services reflect results observed in specific cohorts under specific conditions. Individual results will vary. Crucible Care does not promise or guarantee any specific outcome for any individual participant.

7. Third-Party Links

The Services may link to third-party websites. We are not responsible for the content or practices of those sites. Your use of third-party sites is at your own risk.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, CRUCIBLE CARE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CRUCIBLE CARE’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). CRUCIBLE CARE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This limitation does not apply to liability that cannot be limited under California law, including gross negligence, willful misconduct, or fraud.

10. Indemnification

You agree to defend, indemnify, and hold harmless Crucible Care from claims arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including suspected violation of these Terms. Sections 5, 6, 8, 9, 10, and 12 survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the Services after a change constitutes acceptance.
